Personal data protection policy

Ch. I-   Introduction

Data protection is very important for us. We respect your privacy and personal life. Therefore, we will inform you below on the processing of personal data when you use the services within online applications and on the internal processing activities made available by Tipografia Real.

As for us, SC Tipografia Real SA is a company established in Bucharest, blv. Iuliu Maniu, no. 220B, District 5, registered in the Commercial Register with serial number J40/885/1993, with tax registration number RO 5330280.  Our company has been active on the Romanian market for 20 years and specializes in the following elements: advertising printing, book printing, custom forms, financial-accounting printing, rolls for cash registers, mailing and billing, being, in total, a major supplier of printing products and services.

Our institution is responsible for compliance with the provisions of the General Data Protection Regulation (Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, abbreviated in English GDPR or in Romanian RGPD). In addition to this regulatory act, our institutions are carry out its activities in accordance with Law no. 190/2018  on the measures for implementing the GDPR.

 

The General Data Protection Regulation is an european regulation which has a role in protecting the processing of personal data and the rights and freedoms of natural persons relating to their personal data, establishing the free movement of such data.

 

This personal data protection policy describes our practices on processing (activities including collection, use and potentially transfer) of data directly communicated to Tipografia Real as well as the use of personal data collected by organizations within the group from public sources for the purpose of providing services and our products:

  • Offering requests for printing services;
  • Registration of the order made by you as regards printing products and services;
  • Communicating with customers in order to successfully complete the purpose for which we offer our services.

In our activity, we are making us responsible for strictly respecting the principles existing at the level of the GDPR. Some of the GDPR principles after which we guide are: lawfulness, fairness and transparency- in this sense we are processing your personal data in a concise, comprehensible form, only according to legal basis, respecting the conditions imposed by this regulation; pupose limitation- processing of data is carried out for a clear, well-defined and established purpose known from the beginning; data minimization- processed personal data will be only those relevant to the situation and limited only to the established purpose; accuracy- which indicates that the data processed must be accurate, and updated-etc.

Our data protection practices comply with applicable data protection legislation but if, for whatever reason, the terms set out in this data protection policy are not acceptable to you, you can communicate your objection at the address dpo@tipografiareal.ro .

On the website of our organization, there will also be an information note on the processing of personal data for human resources purposes- in the case of the recruitment of new employees when opening a vacant post.  Therefore, persons interested in applying for a vacancy in our organization are invited to be aware of this information note which can be found in the "Careers" section of our website.

Ch. II- Definitions and clarification of certain concepts

  1. Personal data


Personal data is all data that relates to you in terms of the individualization of each profile. These generally include personal identification data and characteristics (name, first name, CNP, email address, telephone number, residence address, IBAN account and other billing data, citizenship, etc.), electronic identification data (identification elements from various applications, IP, Skype ID, Facebook ID, Instagram, etc.).

In the course of our activity, regarding the customers we work with or potential customers, and the users of our site Tipografia REAL - tipografie Bucuresti, the personal data processed can be: name, first name, IBAN, e-mail address, telephone number, home address, IP address or other personal data that you entrust to us when you choose to obtain a product or service from us.

  1. Data subject. Personal Data Processing. Operator, processor

First of all, it seems appropriate to explain the concept of data subject, common in this notification and beyond. This concept refers to that person whose personal data are processed, and who enjoys protection and safety thanks to the GDPR.

In the case of the processing of personal data by the Tipografia Real, the following persons have the status of data subject:

 

  1. Customers/potential customers, bidders, contractors/suppliers, agents or their representatives;
  2. Shareholders of the Company, managers, censors, collaborators;
  3. Employees, candidates, family members concerned, persons who have submitted CVs for employment.Regarding employees the specific information note is present within organizations, and regarding candidates please find information in the specific information note at: ...

    At the same time, we provide a definition for the concept of processing, which means any operation or set of operations carried out on personal data or on sets of personal data, with or without the use of automated means, such as collection, registration, organisation, structuring, storage, adaptation or modification, extraction, consultation, use, disclosure by transmission, dissemination or otherwise making available , aligning or combining, restricting, deleting, or destroying. Therefore, whenever your personal data, provided by you or by other people but in your interest is collected, and then used in various ways, we can consider that your personal data is processed.

    According to the GDPR, 'controller means the natural or legal person, public authority, agency or other body which, alone or together with others, determines the purposes and means of processing personal data'.

In this situation, SC Tipografia Real SA performs the role of controller, processing the personal data received from customers, employees, candidates, etc., being the one who sets the framework and rules of processing. In this context, it is obliged to ensure that its processing activity complies with the rules imposed by the GDPR in order to provide certainty to data subjects who entrust their personal data for the purpose of certain purposes.

The text of the GDPR also defines the concept of processor as 'the natural or legal person, public authority, agency or other body processing personal data on behalf of the controller'. It shall process the personal data of the data subjects only with the consent of the controller, within the limits and conditions imposed by the controller.

In the present situation, the processors may be employees of SC Tipografia Real SA, who process the personal data they receive when performing their specific activity.

 

3.      Volume of services provided

In the following, we will describe the volume of services provided by us, based on the existing solutions available to you: relationship management systems (CRM/ERP), call-center systems, electronic systems for the collection of information provided by third parties, electronic messaging systems, and especially through websites with online registration, sign-up, communication services.

a.      Basic services

In the case of the basic service, it is provided through the systems for managing the relationship with the candidate/applicant or persons empowered by him/her, of the request for consultancy or financing in the educational area. In case of providing services for students under the age of 16, the processes and activities will be carried out only after obtaining the approval of the parent/guardian, his data being processed as well.

All information collected about you is strictly used for the individual purpose for which it has been collected, according to the mandate granted and/or the contracts concluded – where applicable. Our group owns other internal operational systems to meet the requirements and provide the necessary support for the performance of the contracted services, through which we transit the information collected in order to provide the best services related to the request received.

  1. Web user account

When making the user account registration (name, surname, e-mail and phone) in the application from the websites and submitting the login details related to this account, Tipografia Real processes the data related to communication to our team for the purpose explicitly requested by you.

Ch. III-  Purposes of processing your Personal Data

In the following, we will present one at a time the purposes for which your personal data are processed at the level of our organization, exemplifying for each of these purposes the categories of personal data at issue.

1. Processing of personal data in the context of the provision of printing services

When obtaining our printing products and services, you make us available for the purpose of registering our order and subsequently for the provision of our basic services, the following personal data:

  • first name and surname;
  • contact details: e-mail address, telephone number, physical mailing address;
  • tax identification data: CNP and/or address.

In the case of representatives of legal entities, details of the position/role within the company may also be taken over.

In addition, because we provide you through our website with the opportunity to share your message with us. -in order to obtain clarification, information, to initiate certain complaints or suggestions, etc.-, with this process takes place the processing of your personal data you give us in this context: name, first name, telephone number, plus other possible personal data that you insert in the sent message.

Data are collected depending on the type of applicant's request, not all categories are required.

This data is necessary to carry out the above mentioned operations requested by you, in accordance with Romanian law.

Our company does not request or process personal data in special categories, but only necessary and relevant non-sensitive data, unless it is legally necessary to do so at a later stage. Data considered sensitive/special could be, but not limited to: information on race or ethnicity, political opinions, religion, trade union membership, health, sexual preferences or criminal record.

Our company does not allow the use of services of persons who have not reached the age of 16, thus not collecting data from children/minors.

2. Processing of personal data for marketing/advertising purposes

By giving your consent regarding the receipt of information and advertising, we want to inform you about the current products, services, contests, surveys and promotions. The data provided will be used to be classified in a specific area of interest so that the information provided is relevant and useful to your request.

If you opted for a notification by mail, we will process data such as your name, surname, address.

If you opted for a notification by e-mail, we will process your e-mail address, which has been verified beforehand.

When you choose to receive notifications on your mobile phone, we will process your mobile phone number.

Processing for this purpose will be carried out only if your written consent exists and only as long as you maintain this agreement. You can withdraw this agreement at any time by clicking on the "Unsubscribe" link in the footer of any email you receive from us or by contacting us at the email address newsletter@tipografiareal.ro.

3. Other purposes for processing your data Personal

1. Statistics services

In this case, it is involved informations about: the type of services requested, the types of materials used. This is anonymised statistical information that will only be used to improve the services provided.

2. Improving services

This purpose leads to the identification of problems or possible relevant issues relating to existing services in order to improve them, to the implementation of new services or up-data to existing ones, to the resolution of your complaints.

3. Fulfilment of legal obligations

This way, processing takes place in order to fulfil the various legal obligations of the company, such as: in the field of security, the preservation of archives or other obligations imposed by the laws in force.

4. Video surveillance

Tipografia Real processes personal data through video surveillance, processing aimed at ensuring the security of persons and property, as well as the security and protection of property, real estate, values, without prejudice to your fundamental rights and freedoms or interest.

5. Recording of telephone calls via Call-center

Tipografia Real’s Call Center Service is a support service related to printing services, in order to obtain appointments, requests/sessions/information supplies, etc.

6. Issue of financial-accounting documents to you

In this situation, your personal data is processed for the purpose of issuing financial-accounting documents -tax receipts or invoices-, receipt of payments from beneficiaries for services rendered, recovery of debits from you – a process that may also involve the involvement of third parties to recover claims-, refund of sums of money to you, transmission of notifications related to the financial situation/status of payments, preparation of various reports or statements related to financial records.

7. Dispute resolution

In this case, it’s about of making various requests/opinions in the event of disputes about the services provided to you and/or about the relationship established between you and the company.

Ch. IV Recipients or categories of recipients of personal data

In principle, your personal data will be processed by Tipografia Real.

Considering the complexity of the services provided to you by Tipografia Real and the need for printing to call on certain external partners who provide support in carrying out the work of the printing press, we would like to inform you that your data may also be forwarded to other natural or legal persons for processing for the purposes detailed in this information note.

Taking into account the context of the relationships established by the printing press with its partners (either part of the group or outside the group) and the possibility of various changes in these relationships, it is not feasible to identify all these partners nominally, which will be mentioned generically, depending on the established/potential relationship with Tipografia Real.

For this purpose, your personal data may be transmitted to:

1. Sales agents collaborators

In order to carry out sales operations throughout Romania, it is possible that certain sales agents are collaborators of Tipografia Real with whom the printing press has established precise and detailed contractual relations, including compliance aspects with regard to the protection of personal data.

2. Partners in the execution of printing services

In this regard, we inform you that the data/information collected from you, regardless of their content or volume, may be communicated to accredited printer service providers in the country or in other countries (whether it is a State in the European Union or outside the European Union), in accordance with the applicable legal provisions. However, we specify that the printing press will address appropriate minimisation and technical measures so that all materials or requests for services adjacent to those offered in the printing press are done by means of pseudonymisation methods (identification with a unique file number instead of exposing other information about you). Where this is not possible, you will be asked to transfer or request those services directly from you.

3. Situation of institutions and/or judicial, research, supervisory and control institutions and/or authorities

In a certain masure, in accordance with the legal provisions in force, personal data/information is required to print various bodies and/or institutions (e.g. criminal investigation bodies, police, financial, tax, social security, courts and any other institutions and/or supervisory and control authorities), the printer is obliged to provide the requested data/information without requiring your prior consent, including if you do not express your point of view.

In addition, in certain situations such data/information may need to be made available without prior request from these institutions, bodies and/or authorities, in which case the printer will transmit the necessary data/information in accordance with legal requirements.

4. Insurers

Entities in Romania or other countries, in the context of the services carried out in the framework of the printing press and/or within its partners (where applicable).

5. Other recipients

Tipografia Real may also present your personal data to other third parties, such as: IT support service providers or technical and organisational services in connection with activities related to the maintenance of printing equipment, marketing service providers, payment services, archiving services, legal consultants, auditors, financial accounting consultants or other consultants of the Company and/or entities within the Real Group, in connection with extraordinary business transactions (e.g. in the case of mergers, acquisitions and the like), with which the Company and/or that entity in the Real Group will enter into confidentiality agreements, in an appropriate manner (to the extent that certain legal and/or confidentiality requirements/guarantees are not applicable to them).

Your personal data may also be transmitted to other natural or legal persons in Romania or outside the country in the context necessary to establish, exercise and/or defend a right of printing or other entity within the Real group in court.

We would like to assure you that the Company will exercise due diligence in selecting third-party service providers and/or its partners and will require that these providers/partners maintain appropriate technical and organisational security measures to protect your personal data to which they have access and to process them in accordance with applicable legal provisions.

Where the processing of personal data is carried out by the printer through persons empowered by it, the printing press shall ensure compliance with the specific requirements imposed by the provisions of Article 28 of the GDPR, ensuring, inter alia, that:

(i) those processing operations for personal data are carried out under a contract addressing the specific issues of the operator-empowered relationship, in accordance with the GDPR;

(ii) the processor shall carry out the processing of personal data on the basis of the instructions of the printer.

Ch. V Duration of data storage

We intend to keep your personal data accurate and up-to-date.

We also strive to retain your personal data no longer than is necessary to fulfill the purposes listed in this briefing note or than the duration provided for by applicable law.

In this respect, we inform you that we will store your personal data for the entire period of the established relationship with you, but also thereafter, for a certain period of time, in the light of the applicable legal provisions.

In this way, personal data will be retained for a period of between 2 months and 10 years, in accordance with the relevant legislation, under maximum security conditions. Personal data shall be processed for as long as necessary to achieve the abovementioned purposes, after which they may be anonymised for research or statistical purposes.

The minimum period of 2 months applies to those customers who have requested offers but have not resulted in the selection of a printing or other service involving printing.

To the extent that certain personal data are included in or are also related to certain accounting documents of the Company, for which a specific retention period (e.g. 5 or 10 years) must be observed, such personal data will be retained for those applicable periods.

As regards images obtained by video surveillance means, they shall be maintained for a maximum period of 30 calendar days from the date of registration.

Calls made through the printing press centre shall be recorded and maintained for a maximum period of 30 days from the date of registration.

Ch. VI The use of service providers for processing personal data/processing data in countries outside the European Economic Area

In specific situations, your personal data will be transferred to entities located in other countries within the European Union and/or the European Economic Area in order to carry out various specialised analyses in the context of the printing services provided to you.

There are also situations when your personal data will also be transferred to entities outside the European Union and/or the European Economic Area, also for the purpose of performing specific/special printing services requested in the context of the services provided by the printing press. In such cases we will ensure that adequate safeguards are in place to allow the proper transfer, in accordance with the requirements of the law on the protection of personal data (guarantees which may include: the application of standard contractual data protection clauses or the existence of a decision of the European Commission adopted to that effect).

Ch. VII The source of personal data

Your personal data that Tipografia Real collects and processes later comes from various sources. In the following we will present each of them.

First, our company processes the data of those who access the website www.tipografiareal.ro or the company's headquarters - customers or potential customers or their representatives -, directors, directors, shareholders, agents, contacts)-, suppliers or business partners, employees and collaborators.

Secondly, when you access the company's website, our servers automatically create records of your visit. These records usually include IP addresses, the number of hits, the website you signed in from, and other data. We use cookies or other means of automatically storing data to collect certain types of information that you provide when you interact with the www.tipografiareal.ro website. Please see our Cookie Policy.

Third, we're getting more information about you. when you provide them to us in person, or by empowered:

•         directly at our premises (e.g. when requesting offers, products, or when entering into contractual relationships of any kind with our Company);

•         when sending requests by e-mail, fax, post or telephone;

•         when necessary to execute a billing/payment/commodity opinion operation;

•         through our website, when registering your account or when accessing other information available on a registration basis;

Ch. VII Legal ground for the processing of personal data

The legal bases of the processing of personal data carried out by the company are as follows:

1.       Grounds for the processing of Personal Data not falling within the category of special personal data (according to Article 6 of the GDPR)

Personal data not falling into the category of special data (as defined in Article 9 of the GDPR) shall be processed by the Real Printing Press on the basis of the following legal bases:

a.       mainly, to take steps, at your request, before the conclusion of a contract or to execute a contract concluded by Tipografia Real with you (concerning the services provided by Tipografia Real). It was also considered contractual basis and registration within the website and the conduct of orders through the Online Store module;

b.       in marketing communications, we will process your personal data on the basis of your express consent - this agreement is requested either by filling out a form in the printing site, which can be made with the initial registration in the database, or even later, either through the registrations forms on the website or on the occasion of participation in events, etc.);

c.        call-center/TelePrint calls shall be recorded, on the basis of the free consent expressed in advance by the caller, the processing aimed at preventing misinterpretations of information transmitted by any of the participants in the call, clarification of situations exposed in the context of telephone communication in the event of doubt or confusion, the management of situations where the conversations contain indications of touching that may be related to the security and integrity of the person and property;

d.       in order to permanently improve the printing services provided, your personal data related to the opinion expressed by you by filling in the form made available on the feedback page http://www.tipografiareal.ro/32-1-solicit_contactare.html is processed on the basis of your consent expressed prior to the submission of the form on the web-site;

e.       also, in view of the other purposes for which we process your personal data, the basis for such processing may be the fulfilment of the legal obligations of Tipografia Real (including with regard to archiving, security, record-keeping, request of a public authority and other obligations that the law imposes);

f.         in certain situations, we will process your personal data on the basis of a legitimate interest of Real Printing or a third party -such as: recording appointments in the electronic printing system; the resolution of requests and complaints received from customers; surveillance through the camera system to ensure the security of goods and persons).

2.       Grounds for the processing of Personal Data falling within the category of special data (according to Article 9 of the GDPR)

In view of the specific nature of the activity performed by Tipografia Real, we will not process your personal data falling within the category of special data as defined in accordance with Article 9 of the GDPR).

Ch. VIII Data security

As an operator, we are committed to protecting your personal data as soon as we are in their possession.

The Company uses security procedures and takes what it deems appropriate to guarantee the personal data that our customers or employees or others provide to the Company. The purpose of the Company is to prevent unauthorized access, maintain data accuracy, ensure proper use of data and protect data from loss, misuse or alteration of information under the Company's control.

We take technical and organizational security measures to protect your data from unwanted access as much as possible. Besides securing the operating environment, for example, in certain areas (client account, contact form for the site) we use the encryption process. The information you provide will subsequently be transmitted in encrypted form, using Secure Socket Layer (SSL) protocol to prevent inappropriate use of data by third parties.  You can identify this aspect by seeing the closed padlock symbol in your browser’s status bar, and the address bar starts with “https”.  Data security will be adjusted according to the current technique.

In order to protect personal data from accidental or unlawful destruction, loss or alteration, and access by unauthorized persons, we use security methods and technologies, together with this user security policy:

1. Users who have access to the database of personal information are employees and management of the company; each of them accesses the database with their own account name and password. It should be noted that after five wrong password e-enters the account crashes. All users are obliged to keep the data they have access to confidential, and every session ending in the database will close the session. If one or more users are canceled for various reasons, access accounts are automatically suspended. Also important to note is that users access personal data only for the performance of their duties.

  1. A backup of the database shall be made at intervals (monthly). Database backups shall be kept in rooms separate from the spaces in which personal data are stored or operated, and access to them is restricted. 

    3. Computers from which the information database is accessed have implemented up-to-date antivirus, spam and firewall protection solutions. 

    4. The printing of personal data shall be carried out only by users authorised for this operation and only for the purposes required by GDPR legislation. 

    5. The Company's headquarters are equipped with an alarm system and personal data is stored electronically in secure, password-protected files. The paper information shall be kept in special files, to which only the employees of the company have access, to which the obligation of confidentiality is subject. 

    6. Our company ensures that the training procedure for the persons empowered by the operator and their employees is carried out in order to comply with GDPR rules and to make their importance known. Where there is a transfer of personal data from the controller to the processor or employees, it shall be carried out under legal, security conditions, meeting the necessary guarantees. If we, as an controller, work with another controller in the processing of personal data, we guarantee the lawful and transparent conclusion of an agreement on the processing of personal data, in which the content of which the disclosure of personal data to the other controller is explained at length, all of which are carried out under conditions that ensure the protection of the processing of your personal data. Personal. 

    We also don't keep your data more than necessary, so we keep them only for a long enough period to fulfill the purpose for which we have collected them. On the expiry of the storage period, we initiate actions to destroy them, unless the legislation requires us to keep them for a longer period of time.Despite our best efforts, if we detect a security breach, we will inform you so that you can initiate appropriate safeguards.

    Ch. IX Your rights

     

1.        Right of access

You may request information from us at any time about the data stored about you, as well as, amongst other things, about the origin of the data, the recipients or categories of recipients to which the data is transmitted and about the purpose of storage. For all other copies except the first copy, reasonable administrative costs may be charged. This does not apply to the electronic communication of information.

  1. Right of withdrawal

If you have consented to the use of data, you may withdraw it at any time with effect for the future (once the contracted services have been completed), without giving any reasons. For that, just send an e-mail to dpo@tipografiareal.ro .

Also, the right to erase your personal data may be exercised under certain circumstances provided by the applicable law, including: the situation where personal data is no longer necessary for the purposes of processing, the situation in which the data subject opposes processing and there are no other legitimate interests that prevail for processing, the situation in which personal data has been processed illegally.

  1. Right to rectification

If your data collected by our organization is incorrect, you can request its correction at any time by contacting the project/service of interest to you or the representative you are in contact with.

  1. Right to erasure

You are entitled to obtain from Tipografia Real the erasure of your data, which may be exercised under certain circumstances provided by the applicable law, including: the situation where Personal Data is no longer necessary for the purposes of processing, the situation in which the data subject opposes processing and there are no other legitimate interests that prevail for processing, the situation in which Personal Data has been processed illegally.

Erasure of your personal data can be made at any time, by requesting the already announced methods or by using our general contact data for each project/service. Usually, your data is erased immediately, but no later than one month from requesting this right.  If data erasure is contrary to or maintaining the data is necessary according to data storage obligations established by law, contract or legal regulations, respectively commercial regulations or other reasons provided by law, instead of erasure, only data blocking may be performed. If this is the case for your customer account, you will receive a notification from us in this respect. After erasing your data, it is no longer possible to receive the information.

If you did not use your account for 5 years, your account will be considered inactive. In this case, any personal data that is no longer necessary to be stored for legislative reasons will be erased after the above-mentioned term. Personal data (such as basic data) that must not be erased for legal reasons will be blocked for your safety.

  1. Right to data portability

In case you request your personal data made available, if you wish, we will provide or communicate the data to you or another responsible person in a structured, common and electronically processable format. The latter is valid only if it is technically feasible and only related to the data you have entrusted to us. The data obtained from the services rendered is not subject to such a process, and a discussion will be addressed separately.

  1. Right to object

You have the right to oppose data processing under the conditions and cases provided by the applicable law (including data processing for direct marketing purposes) at any time and without giving any reasons. In addition, we would like to draw your attention to the fact that, by refusing all data processing processes, it is possible that the performance of the contract for the services hired and the development of the programs for customers may be limited or cannot be done, thus asking you to analyze carefully before submitting such requests.

  1. Right to the restriction of processing

The right to the restriction of processing means your right to obtain from the Company the restriction of processing in the following cases:

(i) contesting the accuracy of the data (restriction will take as long as it is necessary for the Company to verify the accuracy of personal data);

(ii) processing is illegal and you object to the deletion of data by requiring restrictions on their use instead;

(iii) The company no longer needs personal data for the purposes for which it was previously collected and processed, but you request the personal data for the finding, exercise or defence of a right in court;

(iv) you have objected to the processing for the period during which the Company verifies that the legitimate rights of the Company prevail over your rights.

  1. Right not to be subject to an automatic decisionThis means that as a user of our services, you will not be subject to a decision of ours based exclusively on the automatic processing of your data (including profiling) that will have legal effects on you or affect you in a similar way to a significant extent.

 

  1. Extensive rights in terms of data processing for personalized assessment

Apart from the above-mentioned rights, in terms of data processing for personalized assessment (where profile creation is applicable), you have the additional right to human intervention in the decision-making process, the right to challenge the decision and the right to express your point of view.

Chapter XI No automatic decision-making

In view of the specifics of the relationship established between the printer and you, we inform you that you will not be subject to a decision based solely on automatic processing, including profiling, which produces legal effects that concern you or affect you in a similar way to a significant extent.

Ch. XII Contact (for the enforcement of the rights of data subjects)

If you contact us by e-mail at dpo@tipografiareal.ro or by mail (Bd. Iuliu Maniu, nr. 220B, District 5, Bucharest), the information provided by you (your e-mail address, your name and phone number, if appropriate) will be stored by us to answer to questions and respectively to comply with your request. We erase the data appearing in this context after the storage space is no longer necessary or we limit processing if there are storage obligations stipulated by law.

Ch. XIII Right to file a complaint
